Common Boundary Dispute Matters

Common boundary dispute matters include:

  • The location of fences. In some cases, fences built by one homeowner may be partially on the property of a neighbor.  Questions can arise concerning the property wrongly included in the fenced area, particularly if the neighbor wants to take immediate action (such as tearing down the portion of the fence that is no his or her property).
  • Claims of Adverse Possession. The law of adverse possession prescribes the terms and conditions upon which the real property of one person may become legally owned by another person.  There are a number of conditions that must be satisfied in order for such ownership transfer to take place. In some instances, it may be necessary to obtain a court ruling on the subject property in order to better clear title.
